Last Will of Joseph Cary: Be it remembered that on the twentythird day of September one thousand eight hundred and fourteenpersonally appeared before me Philo Ruggles surrogate of the lawCounty Jereusiah Rozell of Fishkill in Law County who an oathdeclared that he did see Joseph Cary sign & seal the annexedwritten instrument reporting to be will of the said Joseph. (buthaving no date). I heard him publish and declare the same as Ifor his last will & Testiment that at the time thereof he thesaw Joseph Cary was of sounddisposing & mind & memory to thebest of the knowledge & belief of him the said Jereusiah & thathe the said Jereusiah, Allen Shepard & Jacob Schouton severallysubscribed the will as witnesses thereto in the Fetatorspresence.Philo Ruggles Surrogate: The people of the State of New York bythe grace of God free & Independant: To all to whom thesepresents shall come or may concern said greeting. Know yee thatat Poukeepise in Doutchess County on the twenty third day ofSeptember in the year of our lord one thousand eight hunderd andfourteen before Philo Ruggles Esquire Surrogate of our saidcounty the Last Will & Testiment of Joseph Cary deceased a copywhereof is hereinto annexed was proved & is now approved &allowed of by us & the said deceased having whilest he lived &at the time of his death good Chettels, or credit within thisstate by means whereof the proving & regesteringthe said will &and the granting administration of all & singular the said goodchattels & credits & also the auditing, allowing & finaldischarging the account thereof doth belong unto us: theadministration of all singular the said good chattels & creditsof the said deceased & any way concerning his will is grantedunto Thomas Cary & John Cary, two of the Executors in the saidwill named they being first duly sworn well I faithfully doadminister the same & to make & exibit a true & perfectinventory of all singular.In the name of God Amen I Joseph Cary of the town of Fishkill,Dutchess County and The State of New York being weak in body butof perfect mind & memory blessed be Almighty God for the same domake & Constitute this my last will and testament in manner asfollowing that is to say first I give my soul to Almighty Godthat gave it me & my body to be buried in a Christian likemanner at the descretion of my Executors whom I appoint my sonsThomas, Jesse, & John. Second I order land to be devided betweenmy two sons Jesse & John that to devide the meadow equal & thenacross to John N Bailey's line & Jesse to have the south part &to have five rows of apple trees on the east side of the orchardingrada the term of seven years & John to have the north part. Ialso give my son Thomas one hundred dollars, likewise my sonMatthew one hundred dollars, & my son Isaac one hundred dollars,my sons Joseph, Samuel, William & Nathan I give them each tendollars. I also give Oliver (?) son Cary (?) five dollars & mymovable property to be sold & divided among my daughters equalexcept one bed & bedding which I give Joanna & Excepting Sarah &I gave her twenty five dollars then the remainder to be devidedbetween Mary, Phebe, Martha, Polly & Susan - the legaises Iorder my son Jesse to pay one hundred dollars of them & theremainder I order that my son John to pay & John to pay all mylawfull debts & likewise to find & support his sister Joanna ina decent manner - I hereby revoke all other wills by me made. -Joseph Cary
